Motor Third Party Liability Insurance

Compulsory third party liability insurance for owners or users of motor vehicles.

In accordance with the law, all owners or users of motor vehicles are obliged to conclude a third party liability insurance policy.

Motor vehicle operation represents potential danger, which may cause the following damage to third parties:

  • death
  • personal injury
  • health damage
  • loss or damage to property.

Who are third parties?

Third parties are pedestrians and passengers in another vehicle which took part in the accident. Passengers in your vehicle are also considered third parties.

In accordance with the law, the persons who are not entitled to compensation under motor liability insurance include:

  • the driver
  • the driver's legal successors, for damage due to driver's death or injury
  • the owner, co-owner or any other user, for damage to personal property or items transported in the vehicle.

Bonus and discounts

The amount of the insurance premium depends on bonuses and discounts stipulated by the law.

BONUSES:

You receive a bonus for each year without any claim reported on your motor third party liability insurance policy:

  • after 1st year - 10%
  • after 2nd year - 15%
  • after 3rd year - 20%
  • after 4th year - 25%
  • after 5th year - 30%
  • after 6th year - 35%
  • after 7th year - 40%
  • after 8th year - 45%
  • after 9th year - 50%

The entitlement to bonus is exclusive to the owner or user of the vehicle and is not transferrable to new owners. Exceptionally, when the vehicle's title deeds are transferred to a member of the owner's nuclear family [spouse, children, parents], the entitlement to a certain premium degree is transferred to the successor.

Exceptionally, the entitlement to the accrued premium degree may be transferred to the policyholder's spouse if the policyholder sells or unregisters the motor vehicle [passenger cars and motorcycles only].

If you are purchasing another vehicle [natural persons only], based on the accrued bonus on your current motor third party liability insurance policy, you and your spouse are entitled to the following bonus for the new passenger car from the same premium group [passenger cars and motorcycles only]:

The insurer will recognise the accrued premium degree if presented with the original copy of a previous third party motor liability insurance policy or certificate from a previous insurer or by checking the Croatian Insurance Bureau's records.

DISCOUNTS:

The policyholder may use one of the listed bonuses for a single passenger car only. A discount is available for:

  • Persons with physical disability of 80% or more may obtain a discount of 15% of the total motor third party liability insurance premium. The proof of physical disability should be presented in the form of an original certificate issued by the Croatian Pension Insurance Institute.
  • Persons with physical disability of 80% or more on their lower limbs, or those who are completely blind, are entitled to a bonus of 20% of the total motor third party liability insurance premium. The proof of physical disability should be presented in the form of original certificate issued by the Croatian Pension Insurance Institute.
  • Disabled veterans of the Croatian War of Independence [HRVI] from the physical disability groups I. to V. are entitled to a 20% discount of the total motor third party liability insurance premium.
  • Disabled veterans of the Croatian War of Independence [HRVI] from the physical disability groups VI. to X. are entitled to a 15% discount of the total motor third party liability insurance premium.

    A disabled veteran of the Croatian War of Independence is a war veteran whose body suffered 20% damage due to a wound or injury sustained in the defence of the national integrity of the Republic of Croatia, or as a prisoner of war in an enemy concentration camp, the proof of which should be a valid and original copy of a certificate issued by the Ministry of Defence of the Republic of Croatia.

Territorial cover and the green card

A motor third party liability insurance cover is valid on the territory of the Republic of Croatia and member countries of the "green card" system, unless otherwise stipulated by the contract.

The green card system was introduced on 1st January, 1953 and is primarily a European system, even though it does not include all European countries and does include some non-European countries.

The green card is issued by the insurance company from which you have purchased the compulsory motor third party liability policy. In all member countries of the system, the green card is a valid proof of compulsory motor third party liability insurance for a particular vehicle.

It is usually issued to the policyholder simultaneously with the motor third party liability insurance, but it can also be issued later, if the validity dates on the green card are identical to those on the policy.
The issuing of the green card is free of charge.

Be sure to take your green card with you when you travel abroad and check its expiry date before you go.
